Treaty Amending the Treaty of Corporation and Establishment of the Ecological County (Sanctuary) of Urabba

BETWEEN the

Grand Duchy of Flandrensis (Groothertogdom Flandrensis)

and

Urabba Parks Proprietary Limited

Hereinafter referred to as “parties”

Signed on the 4th day of the month of September in the Gregorian Year of 2023 under the joint consent of both parties.

1. Name

This Treaty is the Treaty Amending the Treaty of Corporation and Establishment of the Ecological County (Sanctuary) of Urabba.

2. Commencement

This Treaty comes into effect on a day appointed by Urabba Parks Proprietary Limited.

3. Amendments

Provisions of the Treaty of Corporation and Establishment of the Ecological County (Sanctuary) of Urabba originally entered into by the parties on 18 August 2022 is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Treaty has effect according to its terms.

Schedule 1—Amendments to the Treaty of Corporation and Establishment of the Ecological County (Sanctuary) of Urabba

1. Title

Omit “Urabba”, substitute “New Eurabba”.

2. Article 3 (definition of County)

Omit “Urabba”, substitute “New Eurabba”.

3. Article 3 (definition of Urabba Street Reserve)

Repeal the definition.

4. Subarticle 5.1

Omit “There shall be a territory”, substitute “The New Eurabba region” .

Omit “having the area of Urabba Street Reserve with the name Flandrensian Ecological County of Urabba”, substitute “shall be established as the Flandrensian Ecological County of New Eurabba”.

5. Subarticle 5.3

Omit “Urabba Street Reserve”, substitute “land it principally occupies in the County”.

Omit “the area of the County”, substitute “an ecological sanctuary of the Grand Duchy of Flandrensis”.

6. Subarticle 5.4

Omit “person”, substitute “member of Urabba Parks Proprietary Limited”.

Omit “abode”, substitute “occupancy”

7. Subarticle 6.1

Omit “may only legislate for the County in the circumstances specified in Schedule 1”, substitute “shall consult with the Grand Duchy of Flandrensis on any legislative proposal that affects the County”.

8. Subarticle 6.2

Omit “may only change its Constitution if required under an Australian law or court/tribunal order, or if the change is reasonable having regard to its obligations under this Treaty”, substitute “shall have regard to its obligations under this Treaty in assessing the reasonableness of an amendment to its Constitution or any act having similar status”.

9. After subarticle 6.2

Insert “3. No law or act is invalid merely by failure to consult or consider under this article.”

10. Article 8

Repeal the article, substitute:

8. Exiting the arrangement

This Treaty shall be revoked if:

(a) there ceases to be any area subject to the laws of the County;

(b) if either party is dissolved or enters external administration; or

(c) 30 days after a party sends a show cause notice under this subarticle to the other party, unless the notice is withdrawn;

and upon revocation of this Treaty the parties shall stop recognising the area forming the County as an ecological sanctuary of the Grand Duchy of Flandrensis and Urabba Parks Proprietary Limited shall stop using the identity of the Grand Duchy of Flandrensis in relation to any of its activities, unless otherwise authorised by the Grand Duchy of Flandrensis.

11. Article 9

Omit “the party”, insert “a party”.

Omit “declared as such for the purposes of this article”, insert “produced, used or transferred under this Treaty”.

Omit “parties involved in the production of the material”, insert “party”.

12. Article 10

After “enterprise”, insert “between the parties”.

13. Schedule I

Repeal the schedule.
