The Saspearian Constiution

Drafted through November and December 2020 and ratified on December 31, 2020 in Unueco, Saspearian.

Preamble

I, Emperor Anthony I, the Emperor of Saspearian hereby proclaim a reformation of Saspearian’s government from an Absolute Monarchy to a Constitutional Monarchy, as I believe it’s in the best interests for the nation.


Terminology

  • a. The terms “Head of the Royal Family” and “leader”, and so forth will be considered as synonyms in the context of this constitution.
  • b. The terms “Saspearian”, “the country”, “the nation”, and so forth will be considered as synonyms in the context of this constitution.
  • c. The terms “citizens” and “people”, and so forth will be considered as synonyms in the context of this constitution.
  • d. The terms “proposal” and “resolution”, and so forth will be considered as synonyms in the context of this constitution.
  • e. The terms “member of parliament” and “delegate”, and so forth will be considered as synonyms in the context of this constitution.


Article 1

  • Section 1: The Head of the Royal Family, also sometimes referred to as the Emperor or Empress of Saspearian is the highest position and leader of Saspearian who serves as the head of state and government as well as the leader of the Royal Family and the leader of the Monarchy of Saspearian. It is the leader’s job to handle all foreign relations through micronational and macronational entities. If the leader wishes he or she may appoint an ambassador for a micronation or macronation.
  • Section 2: The Emperor and Empress of Saspearian must be considered as a part of the royal family and the oldest of whom will serve as the head of the royal family. A partner of a Royal family member is considered to be a part of the royal family, unless, in the condition of an exception by the royal authority.
  • Section 3: Nobles are members of the Monarchy of Saspearian, who are appointed to serve as a monarch by the leader.
  • Section 4: In the occurrence of a proposal which passed from parliament, the leader will either accept or veto it for a proper motion. Term lengths for this position are for life or upon abiddication.
  • Section 5: The leader will be succeeded either through bloodline or approval of appointment by the Emperor or Empress. If there are no descendants left, it must be decided by Parliament to elect a new leader. In vacancy of this position, the eldest descendant of the leader has the right to be crowned as the head of the royal family.
  • Section 6: If the leader wishes he or she may establish subsidiaries of the government.


Article 2

  • Section 1: Saspearian must have a parliament that serves as a legislative body which represents all of Saspearian’s provinces, with one delegate serving for each province. The delegations have the ability to vote on propositions through approval, opposition or abstain. A motion will pass or fail with a tallied two-thirds majority vote as the general consensus. Sessions for the Saspearian Parliament will be organized by either the Head of the Royal Family or the Prime Minister, which is convened at a fortnightly (fourteen days) basis on a Saturday at a designated venue by the leader or at a more convenient time. Each session is composed in the order of a proposition, discussion and debate, the resolution, and a reminder for if there’s any final business. The region of the Capital will have one delegate, known as the Capital Delegate, whose sole purpose is to break ties in Parliament.
  • Section 2: General Elections, in designation of Parliament’s seats of delegations are subject to be held every two years, which will begin at midnight on the fourth friday and end the following sunday at midnight (forty-eight hour basis), respectively at local time in accordance to their macronational location, in the month of January, with all citizens over the age of thirteen having the ability to vote. In order to declare candidacy for a seat in Parliament, the candidate in question must be a citizen of Saspearian and must fill out a form of candidacy for the position. The candidate may associate with a political party. If a campaign is found to be of corruption, the campaign must be suspended and a trial will be held within three months of the revelation. If a Member of Parliament resigns or dies in office, the seat will be considered as vacant and the seat must be filled in either through appointment by the head of the royal family or a Special Election, which is held at a designated time by the authorization of the leader.
  • Section 3: Parliament may have the power to declare war on a country, under the condition that they pose a threat to Saspearian and that it’s as last resort. The dissolution of government subsidiaries is solely possible through the process of a resolution.
  • Section 4: A temporary suspension in Parliament must occur whenever there hasn’t been a motion in twenty minutes, the session will remain in pause. If there’s an emergency, the session will be fully suspended and if there are proposal(s) that are in the state of pending, the proposal(s) will be voted on at a later time.


Article 3

  • Section 1: Each citizen must be treated as equal and any forms of discrimnation are to not be tolerated. The death penalty and any form of execution is outlawed. Slavery is not allowed and is considered as a crime.
  • Section 2: All citizens have the right to freedom of speech, the freedom of the press and the freedom of religion.

Article 4

  • Section 1: The Supreme Court is the highest court of Saspearian which is made up of five Supreme Justices, whose purpose is to judge all legal cases that have come to the concern of attention for the ruling of the land. Supreme Justices are appointed by the royal authority and must pass a confirmation vote by Parliament in order to assume office. The Supreme Justices serve for life or upon resignation.
  • Section 2: Future revisions to this document have the potential to be implemented under a two-thirds majority vote directly from Parliament.

Article 5

  • Section 1: All citizens have a right to a speedy trial. In a court case, the defendant is innocent until proven guilty by the judge.
  • Section 2: Any searches on property require a search warrant.
  • Section 3: All citizens have the right to a fair trial and due process.


Article 6

  • Section 1: Commerce of goods are allowed free entrance between provinces, territories, crown dependencies, or any other land claims under the nations jurisdiction. Externally, goods may be traded between other nations who are in positive relations with Saspearian.
  • Section 2: The establishment of business entities in Saspearian must go through a process of review in which it should be decided for either an approval or rejection by the Ministry of Economy.
  • Section 3: The government may wish to collect taxes for matters with the development of the nation. Taxes are to depend on the finances of the individual, financially disadvantaged individuals will be taxed the lowest, the individuals who make the most money must be taxed the highest, and the individuals who are in the middle class will be taxed in between. Taxes may be legally evaded in the case that the government is unable to contact the subject, the subject is financially disadvantaged and can’t pay for taxes.


Article 7

  • Section 1: Provinces are land claims of Saspearian that have permanent residents. Territories are land claims of Saspearian that often have a population of zero, with the management of the Head of the Royal Family. Crown Dependencies are land claims of Saspearian that are led by a Commissioner who is appointed by the Head of the Royal Family. Crown Dependencies are led directly from the crown in diplomatic relations and are subject to the nation’s laws. The annexation of new provinces or territories to Saspearian will be official with the approval from the parliament and the other party involved.
  • Section 2: Any land under Saspearian’s jurisdiction must be allowed to secede through a referendum with the approval from the majority of its residents, with the exception of the capital region.


Article 8

  • Section 1: If an individual is born in Saspearian, they will be counted as a citizen of Saspearian. In the case of a parent being a citizen of Saspearian and the other parent being a citizen of a different country, their child will be granted Dual-Citizenship of Saspearian.
  • Section 2: In order for a person to become a citizen of Saspearian, they must fill out the credentials for citizenship with their email, full name, age, gender, type of citizenship (regular or dual citizenship), and the country in which they currently reside in, the application must be reviewed by the leader. A person must become a citizen if they were born in Saspearian.


Article 9

  • Section 1: Ministries are considered as a part of the executive branch who serves as an officer of Parliament. In vacancy of any ministries, the Head of the Royal Family must fill in the roles of these positions.
  • Section 2: The Prime Minister serves as a part of the executive branch and acts as a second in command to the Head of the Royal Family. In order to become the Prime Minister you must be a member of parliament or have had experience in the parliament.
  • Section 3: The ministries of economy, defense, culture, development, and people are established. The primary role of the ministry of the economy is to manage commerce, money and business developments. The ministry of defense will defend Saspearian in the occurrence of an invasion. The ministry of development will handle infrastructure and construction. The ministry of people will conduct censuses every two years and aid in business opportunities for citizens.

Article 10

  • Section 1: The Judicial Court is the lower court of Saspearian who reviews cases which concern civilians in which it is necessary for a review to the existing laws of Saspearian, unless in vacancy. In this occurrence, the Members of the Supreme Court will review the affected cases as a substitute.


Article 11

  • Section 1: Upon ratification of this document, its terms will go into effect on January sixteenth, twenty twenty-one.
