Act 66
In accordance with the Supreme Directive of the Empire of Adammia, on the authority of His Imperial Majesty the Emperor, the Ruling Council and the House of Citizens, in Parliament assembled, this following Act of Parliament is hereby enacted, with the purpose of establishing an Electoral Commission to oversee the Office of State’s conduct of elections and referenda.
Section 1
- a) The Electoral Commission shall be a sub-organisation of the Office of State.
- b) The Electoral Commission shall consist of:
- i. The Chancellor;
- ii. A representative from each political party presently sitting in the House of Citizens, nominated by that party’s president;
- iii. A representative for independent candidates, nominated by the group of all independent members of the House of Citizens not affiliated to any political party.
- c) Where no nomination has been made for any representative identified under the above clauses ii) and iii), the Electoral Commission shall function as if that position on the Commission does not exist.
- d) The role of the Electoral Commission shall be to advise the Office of State on all procedural aspects of the running of elections and referenda that are not prescribed in law, including, but not limited to:
- i. The times at which voting shall open and the time at which voting shall be closed to citizens;
- ii. The manner in which votes shall actually be cast, be that through physical or digital means;
- iii. Procedures through which voters shall be identified and verified;
- iv. The timing of the counting and declaration of election and referendum results.
- e) The Electoral Commission shall meet at least once between the calling of a general election or referendum and the day of the vote, at a reasonable time for the majority of the members of the Commission, to consider the procedures under the above subsection d) with respect to the relevant election or referendum.
- f) The Electoral Commission may also meet for the purposes set out in the above subsection e) with respect to local elections, if the circumstances of the election require the Commission’s advice.
- g) The Office of State, in running an election or referendum, should follow the advice given by the Electoral Commission with respect to that election or referendum. If it deviates from the official advice, the Lord Chancellor must justify its reasons for doing so in a written report delivered to both chambers of the Imperial Parliament.
