Eighth Amendment

to the

Supreme Directive of the Empire of Adammia

In accordance with Article II, Section 2 of the Supreme Directive, entrenched as the fundamental law of the Empire of Adammia since the 30th of June 2013, the changes to the Supreme Directive outlined in this Amendment shall take effect upon the Supreme Directive if this Amendment gains the support of at least 50% of the voters in a fair public referendum open to all full citizens of the Empire of Adammia.

  • 1. Article VIII Section 5 Subsection a) is deleted and replaced with
    • a) The composition of the House of Citizens shall be a number of Members of Parliament representing a number of constituencies.
  • 2. Article VIII Section 6 shall read as follows:
    • a) A General Election of Members of the House of Citizens may be called by the Monarch at any time between one month and two years after the previous General Election. The General Election shall take place on a date specified by the Monarch at least three weeks after the Monarch calls the election.
    • b) There shall be a number of voting constituencies, which shall be:
      • i. Each Adammic region, along with full citizens residing within an area near to the region, as defined by primary legislation; and
      • ii. An overseas constituency, for colonies and full citizens which do not reside in any area near to a region as defined by the above clause i).
    • c) The number of seats in each constituency to which Members of Parliament may be elected shall be:
      • i. At least one; and
      • ii. A further seat for every six full citizens within the constituency.
    • d) The number as defined in the above subsection c) shall be updated when a General Election is called.
    • e) During the period between the calling of a General Election and the date of the Election, any full citizen over the age of twelve may nominate themselves as a candidate in any constituency.
      • i. Presidents of political parties, or their nominated representatives, may also nominate an individual who is eligible as set out above, provided that the individual has so consented.
    • f) If, on the day of the Election, there are fewer nominated candidates than there are seats available in a constituency, or the same number thereof, then all of the nominated candidates shall immediately become Members of Parliament.
    • g) If, on the day of the Election, there are more nominated candidates than there are seats available in a constituency, a poll shall take place, in which all full citizens over the age of twelve who are assigned to that constituency may vote.
    • h) Voting shall take place according to the following procedure:
      • i. Each voter may rank as many or as few candidates as they wish, with a “1” indicating their highest preference, a “2” their second-highest preference, and so forth. Voters wishing only to indicate a first preference may write an “X” instead of a “1”.
      • ii. At the first count, all the candidates for the constituency shall be ordered by their number of first preferences.
      • iii. A quota shall be calculated, which shall be the number of valid ballots cast in the constituency, divided by the number of seats available for election for the constituency plus one. In the event of a fraction, this number shall be rounded up.
      • iv. If, at any stage of counting, the number of votes for a candidate is equal to or greater than the quota, that candidate is elected as a Member of Parliament.
      • v. When a candidate is deemed elected, if no further seats are available in the constituency, the counting shall end. However, if further seats are available, any votes cast for the elected candidate which exceed the quota shall be considered surplus.
      • vi. The surplus votes for an elected candidate shall be transferred to the remaining candidates according to the next-highest preference indicated on the ballot. These transferred votes shall have a weighted value, which shall be:
        • 1. The multiple of the surplus and the value of the ballot when it was received by the elected candidate, divided by the total number of votes assigned to the elected candidate.
        • 2. If a vote does not already have a weighted value from a previous transfer, its value shall otherwise be one.
      • vii. If, after a round of voting, there are no candidates which have reached the quota, but further seats remain available for the constituency, then the candidate with the fewest number of votes shall be eliminated, and the votes shall be transferred to the remaining candidates according to the next-highest preference indicated on the ballot.
      • viii. If, whenever votes are being transferred, there are no remaining preferences on the ballot, the ballot shall be discarded.
      • ix. If, at any stage, there is a tie between candidates, this shall be resolved by random chance.
    • i) The counting of ballots in General Elections, and the announcement of the results of General Elections, shall be done by the Chancellor, or a representative of the Chancellor appointed by them.
    • j) If a Member of Parliament dies or resigns, the vacancy shall be filled by a by-election, which shall take place in the Member’s constituency in accordance with the rules set out in this section. The by-election shall take place three weeks after the vacancy is made. However, if a General Election has been called at the time that the vacancy is made, or is subsequently called before the by-election can take place, the by-election shall be cancelled, and the vacated seat shall be contested alongside the other seats for the constituency in the General Election, and the seat shall be left vacant until that time.
