Constitution of the Kingdom of Burdette

Preamble

We, the people of the Kingdom of Burdette are establishing this constitution to better organize government and to formally set forth how we want our leaders to act and be able to control. This constitution will strive to not only set an outline for the nation but to protect its citizen’s rights.

Section I - Monarch

  1. The Monarch of the Kingdom of Burdette(hereafter Burdette) shall be the King/Queen of Burdette.
  2. The King/Queen shall be the official head of state of Burdette and co-head of state.
  3. The powers of the Monarch shall be the following:
    1. The Monarch shall have the power to issue royal edicts.
      1. Royal edicts may not contradict Parliament laws, court orders, or the constitution.
    2. The Monarch shall have the power to veto laws passed by Parliament.
      1. A veto may be overridden by a ⅘  vote from Parliament.
    3. The monarch shall have the right to declare war and shall lead the Burdette Armed Forces.
    4. The Monarch shall be able to pardon individuals of criminal and civil offenses.
    5. The Monarch shall have the power to sign treaties and conventions.
    6. The Monarch shall have the right to create and confer medals to citizens and foreign entities.
    7. The Monarch shall have the right to confer military ranks to citizens.
    8. The Monarch shall have the power to receive ambassadors and diplomats to Burdette.
    9. The Monarch shall have the power to appoint Ministers.
      1. Both the Prime Minister and the Monarch shall have this power and both must settle on a cabinet.
      2. They may dismiss Ministers at any time.
    10. The Monarch shall have the power to be able to make Burdette join an intermicronational organization.
    11. The Monarch shall have the right to propose legislation to the Parliament.
      1. The Monarch may not vote but they may propose legislation.
    12. The Monarch shall have the power to appoint advisors.
  4. The Monarch shall have the following responsibilities.
    1. Schedule and supervise cabinet meetings alongside the Prime Minister.
    2. Release a report every 3 months of the development and achievements that have been going on. He shall also make a yearly report of development and achievements.
    3. Hold and supervise elections for parliament and prime minister.
    4. Keep government activity high.
    5. Make sure formality is kept inside parliament and other government branches.
  5. The monarch shall have complete immunity from both civil and criminal prosecution including impeachment.
  6. The line of succession for the monarch shall be:
    1. Royal Prince/Royal Princess
    2. Nobles
    3. Prime Minister
  7. The Monarch must specify the line of succession for nobles.
  8. The Monarch shall also choose the royal prince/royal princess.
  9. The different types of advisors shall be:
    1. Economic Advisor
    2. Domestic Advisor
    3. Foreign Affairs Advisor
    4. Military Advisor
  10.  Upon passage of this constitution, the King of Burdette shall be Isaiah Burdette

Section II - Royal Parliament

  1. All the powers of the legislative branch shall be in the Royal Parliament of Burdette (hereafter Parliament).
  2. Parliament shall be made up of 7 seats.
    1. 6 shall be regular voting seats
    2. There may be more colonial seats.
    3. The Prime Minister will automatically get a seat.
  3. The powers of Parliament shall be the following:
    1. Power to pass legislation with a simple majority.
      1. Legislation may not contradict the constitution.
      2. An amendment to the constitution needs ⅔ to pass and if vetoed by the King ⅘ is needed to override the said veto.
    2. Power to declare war with a ⅔ majority.
    3. Power to ratify treaties and conventions with a simple majority.
    4. Power to strike down royal edicts and government orders with laws that override them.
    5. Power to impeach officials with a ⅔ majority.
      1. The monarch may not be impeached
      2. It must be a serious offense to be impeachable.
    6. Approve the Minister of Justices judge nominations.
    7. Confer medals and military ranks.
  4. The Parliament of Burdette shall be elected using STV.
  5. At the beginning of every new Parliament, they shall elect a speaker.
    1. They have the power to hold a vote of no confidence on the Speaker where if more than half of the parliament dislikes the Speaker they will be removed.
  6. The powers of the Speaker shall be the following:
    1. The Speaker shall maintain formality in parliament.
    2. The Speaker shall monitor debate on bills and voting.
    3. The Speaker shall be able to propose legislation.
      1. They may propose legislation but may not vote on it.
    4. The Speaker shall be the official leader of Parliament.
  7. Every member of Parliament must meet the following standard to be eligible to be elected:
    1. Must have attained at least 13 years of age.
    2. Must have never been convicted of an indictable charge.
    3. Must be a citizen in Burdette for a week.
  8. Parliament members shall serve for 3 months.
  9. Every Parliament member shall have the power to propose a bill and it must be debated and voted on.

Section III - Royal Court

  1. The Royal Court(hereafter Court) of the Kingdom of Burdette shall be the sole court and shall act as the judicial branch.
  2. The Court shall be composed of one judge.
    1. The Judge shall be nominated by the Minister of Justice.
      1. The Parliament may run a vote of no confidence on the judge where if 50% or more don’t support the judge they will be removed.
  3. There shall be three classifications of court cases:
    1. Misdemeanors: Minor offenses that do not require a Jury, they require only a judge to make a ruling. (Ex. theft of less than 10$,  assault, etc.)
    2. Triable: A low-level offense that still warrants a jury. (Ex. Theft of over 50$, assault causing bodily harm, violation of funding, etc.)
    3. Indictable: An extremely high profile case that could result in major consequences and warrants a jury. (Ex. Treason, election fraud, etc.)
  4. It shall be up to the Judge to determine the classification.
    1. If the Judge abuses his power he may be impeached.
  5. If the Judge is on trial the monarch shall be the Judge.
  6. Juries shall be made up of 3-5 citizens of the Kingdom of Burdette.
    1. They may not be in the same political party as the accused.
    2. They may not have personal ties to the accused.
  7. Possible punishments could be:
    1. Expulsion from the government.
    2. A fine.
    3. Suspended citizenship.
  8. Judges shall serve as long as the Minister of Justice keeps them there.
    1. The Minister of Justice may not appoint himself as a judge.
    2. The Minister of Justice may not remove a judge in the middle of a court case, or when a case against the Minister of Justice is pending.
  9. The Royal Court will also be tasked with interpreting the constitution and laws.
    1. This will be called judicial review.
  10.  The Court will be tasked with verifying every law passed by parliament is constitutional before it officially goes into law.
    1. If a new amendment is passed that would make the law unconstitutional, the court will have the opportunity to strike down the law.
    2. People may ask for a second judicial review of laws if they see something they think the judge missed.

Section IV - The Prime Minister

  1. The powers of the executive branch shall be vested in the office of Prime Minister of Burdette.
  2. The Prime Minister shall be the head of government of Burdette.
  3. To become Prime Minister one must meet the following qualifications:
    1. Must have attained the age of 13
    2. Must live on or in a 100-mile radius of the Burdette’s land claims.
    3. Must have never been convicted of an indictable offense.
  4. The Prime Minister shall be elected using STV.
    1. Only locals may vote in the election for Prime Minister.
  5. The powers of the Prime Minister shall be the following:
    1. The Prime Minister shall have the power to veto legislation passed by parliament.
      1. It may be overturned by a ⅗ vote from Parliament.
    2. The Prime Minister shall have the power to appoint a cabinet with the monarch.
      1. They must both agree.
    3. The Prime Minister shall have the power to issue government orders
      1. Government order may not contradict Parliament laws, court orders, and constitution.
    4. The Prime Minister shall have the power to pick a Deputy Prime Minister.
      1. Deputy Prime Minister shall have the power to break ties in Parliament
      2. The Deputy Prime Minister shall help lead the cabinet and shall participate in cabinet meetings.
    5. The Prime Minister shall have the power to engage in foreign relations with other nations.
    6. The Prime Minister shall have the power to confer and create awards.
  6. The line of succession for the Prime Minister shall be:
    1. Deputy Prime Minister
    2. Speaker of Parliament
    3. Minister of Foreign Affairs
    4. Minister of Treasury
    5. Minister of Justice
    6. Minister of Domestic Affairs
  7. The Prime Minister shall have a seat in Parliament.
  8. The Prime Minister shall have no immunity from prosecution and is fully liable to the judicial system.

Section V - Emergency Powers

  1. Parliament may give the king or prime minister power to do the following with a 51% majority:
    1. Create a new ministry.
    2. Declare martial law.
    3. Declare a national emergency.
    4. Dissolve the nation.
    5. Void the constitution
    6. Suspend Parliament and transfer its powers and responsibilities to a separate legislature.
  2. The Prime Minister may hold an election at any time to replace him but must give a 10-day notice before voting.
  3. The Parliament may hold an emergency election to replace itself but 75% of Parliament must agree

Section VI - Colonies and other internal divisions

  1. There shall be four classifications of territories in the Kingdom of Burdette
    1. Capital City
    2. Colony
      1. Must have one citizen and is ruled by a Lord.
    3. Duchy
      1. Must have three citizens and is ruled by a Duke.
    4. Principality
      1. Must have five citizens and is ruled by a Prince.
  2. The capital city will be the home of the King's federal government.
  3. Citizens will have free movement between the territories.
  4. To become a colony a treaty will be drafted that must specify the following
    1. How much autonomy the territory will have.
    2. Who will lead the territory.
    3. How many seats the territory will get in parliament.
  5. The Parliament must ratify a said treaty.
    1. If the King or Prime Minister vetoes it will automatically fail and cannot be overturned.

Section VII - Rights of citizens

  1. Each citizen will have the following basics rights:
    1. Freedom of speech.
    2. Freedom of peaceful assembly
    3. Right to bear arms.
    4. Right to a fair and equal trial.
    5. Freedom of religion.
    6. The government shall censor no press.
    7. Freedom of political affiliation
    8. No involuntary servitude or slavery shall take place unless as the punishment of a crime.
    9. Freedom of cruel and unusual punishment.
  2. It shall be illegal for the government to intrude or violate any of the rights listed above.

Section VIII - Nobility

  1. There shall be 5 ranks of nobility:
    1. Non-Royal Prince/Non-Royal Princess
    2. Duke/Duchess
    3. Lord/Lady
    4. Marquess/Marchioness
    5. Count/Countess
  2. Nobility shall be heredity.
  3. The power of making citizens nobles shall be exclusive to the Monarch of Burdette.
  4. Benefits of nobility shall be set through laws.
