Constitution of Gishabrun SAR
The following is the constitution of Gishabrun SAR, Renasia. It was enacted on June 22, 2013, and remained in force until March 17, 2015.
Preface
The Knyaz or Knyaginya, whose rule over Gishabrun is assured by the Gishabrun SAR Treaty (2012), and maintained by the Guntanu’tl of the Free State of Renasia, and the KleinZav Corporation (henceforth “KleinZav” or “The Company”), which was created on July 22, 2012 by an amendment to the Constitution of the Tsarist Empire of Gishabrun (the legal predecessor to the Gishabrun SAR) in order to ensure order, development, and profit in Gishabrun, agree to the terms and conditions described hereafter:
Section 1 - The Knyaz
Article 1 - Definition
The Knyaz (Knyaginya if female) is the citizen of Gishabrun who has the highest meritocratic rating as determined by the government of Renasia. The Knyaz is is the head of the government of Gishabrun and is its representative whenever such a representative is necessary.
Article 2 - KleinZav Position
The Knyaz shall be the Chief Executive Officer of KleinZav, and thus its representative whenever such a representative is necessary.
Article 3 - Appointment Power
The Knyaz has the power to appoint Directors onto the Board of Directors of KleinZav.
Section 2 - KleinZav
Article 1 - Definition
KleinZav is the corporation run by Gishabrun, in accordance with the principles of state capitalism. KleinZav also encompasses any subsidiaries approved by the Board of Directors.
Article 2 - Monopoly
All sales of products or services in Gishabrun must be done through KleinZav.
Article 3 - Membership
Membership in KleinZav can be granted to any individual with the approval of the Board of Directors, and allows them to do business on behalf of KleinZav. Citizens of Gishabrun receive automatic membership.
Section 3 - Board of Directors
Article 1 - Definition
The Board of Directors is the executive and legislative council that controls KleinZav as well as Gishabrun. It consists of:
- The Knyaz
- Director of Gishabruni Affairs
- Director of Research and Industry
- Director of Foreign Business
- Director of Economic Profitability
Article 2 - Duties of the Director of Gishabruni Affairs
The Director of Gishabruni Affairs is responsible for the development of Gishabruni culture, sport, land claims, referenda and popular concerns, oblastian affairs, and national holidays.
Article 3 - Duties of the Director of Research and Industry
The Director of Research and Industry is responsible for scientific research and experimentation, production, and exploitation of resources.
Article 4 - Duties of the Director of Foreign Business
The Director of Foreign Business is responsible for sales, production, and other operations outside of Gishabrun.
Article 5 - Duties of the Director of Economic Profitability
The Director of Economic Profitability is responsible for loaning and storing money, making the budget, obtaining taxes, and managing investments.
Article 6 - Duties of the Knyaz in the Board of Directors
The Knyaz as a Director is responsible for all things not already under the authority of the other Directors.
Article 7 - Requirements for Directorship
To be eligible for appointment by the Knyaz to the position of Director, one must be a member of KleinZav, and, for all positions but that of the Director of Foreign Business, a citizen of Gishabrun.
Article 8 - Term of a Director and Corresponding Referenda
Each Director is appointed by the Knyaz to a position until they either die, resign, are stripped of their position by the Knyaz, cease to meet the requirements for Directorship as per Article 7 of this section, or fail in a referendum by the population of Gishabrun, at which point the Knyaz is legally obligated to appoint a Director to that position within a period of 1 month from the vacation of the position. For a referendum to be called, a petition must be submitted to the Knyaz calling for a referendum on whether a specified Director (but never the Knyaz) is to remain in their position, which must be signed by at least one quarter of Gishabrun’s. If all of the above conditions are met, a referendum must be called and all Gishabruni citizens are obligated to vote either “YES” (to allow the Director in question to maintain their position) or “NO” (to strip said Director of their Directorship). If an absolute majority of votes for one of the two options is achieved, the results can be announced without requiring the remainder of the population to vote. If all citizens have voted and there is an equal amount of support for both sides, the Knyaz may decide the result. The Knyaz may not change the Director in question while a referendum is ongoing. If a result of a referendum is clear, however, the Knyaz must act in the way specified by the majority. A Director that is stripped of their Director title in the aforementioned ways cannot ever become the same type of Director again, unless allowed to do so by a referendum called in the same way as above, but with the options referring to whether to allow this person to serve in the Director position of which they were stripped, which makes them eligible for that position but not automatically in that position unless then appointed by the Knyaz.
Article 9 - Duties of the Board of Directors as a whole
The Board of Directors acts as a whole to make laws pertaining to any Gishabruni or KleinZav affairs. While each Director acts in an executive capacity for their own specialty, the Board of Directors as a whole acts as a legislative entity. The Board of Directors can also veto any decision made by a Director in their executive capacity.
Article 10 - Voting in the Board of Directors
Each member of the Board of Directors has an equal vote in all decisions that the Board of directors as a whole can make. Abstention is impossible. To make a decision, an absolute majority of the Board of Directors must be in favour.
Article 11 - Multiple Directorships
No person can hold the two Director positions at the same time, nor can the Knyaz be a Director at the same time.
Section 4 - Territorial Divisions
Article 1 - Types of divisions
Gishabrun's territory is divided into the following territorial divisions: Oblasts and Krais.
Article 2 - Oblasts
Oblasts are territories that have a permanent population (herein defined as having Gishabruni citizens that sleep in the territory for at least half of the year's nights). Each oblast has one Ambassador (which is chosen by the citizenry of that oblast from themselves in whatever way they see fit) who represents the interests of the oblast and is responsible for said oblast's governance.
Article 3 - Krais
Krais are territories that have no permanent population (see Article 2 of this section). They are represented in all affairs by the Knyaz. To be eligible for claiming, a Krai must be located within five kilometres of an existing oblast.
Section 5 - Official Language
Article 1 - Official Language
In addition to the official language(s) of the Free State of Renasia, there is to be only one official language in Gishabrun, that being the one spoken fluently by the largest amount of people (if not already included among Renasia's official languages).
Article 2 - Usage
All official documents, broadcasts, and dialogues must first be in this language, although translations may be requested by citizens who can prove their fluency in another language.
Article 3 - National Language
In order to promote culture within Gishabrun, an additional language can be chosen as the National Language. Translations of documents, broadcasts, and dialogues may be made in this language, but the Official Language must always be primary.
Section 6 - Symbols
Article 1 - Flag
The flag of Gishabrun is to be a diagonal tricolour, divided with a blue diagonal band extending from the lower hoist-side corner. The upper triangle is maroon and the lower triangle is light green. On top of it all is a yellow drafting compass with its hinge at the upper middle of the flag and its points extending to either bottom corner of the flag.
Article 2 - Seal
The seal of Gishabrun is to be a monochrome design displaying the lower half of the Renasian broken circle in the lower half of the seal and two horizontal lines in the upper half, curving as if enclosed by a circle.
Article 3 - Anthem
The anthem of Gishabrun shall be “Immortal Victims” (in German: Unsterbliche Opfer). The anthem shall be instrumental, and thus shall have no lyrics.
Article 4 - Use of Symbols
These symbols are to be used to represent Gishabrun and/or its government whenever necessary. The flag should be preferred for outdoor displays, the seal preferred for small-scale symbolism or stamp seals, and the national anthem for whenever auditory symbolism is required.
Section 7 - Citizenship
Article 1 - Duties of Gishabruni Citizens
Gishabruni citizens are also citizens of the Free State of Renasia, and all the benefits of Renasian citizens thus apply to Gishabruni citizens. In addition, Gishabruni citizens are automatically members of KleinZav, which allows them to do business in Gishabrun and outside of Gishabrun in KleinZav’s name, as well as become Directors. Finally, Gishabruni citizens can become Knyaz and vote in referenda.
Article 2 - Types of Gishabruni Citizens and Additional Duties
Gishabruni citizens consist of two types:
- Oblastian citizens
- Overseas citizens
Oblastian citizens are citizens that live in oblasts (see Section 4, Article 2). They can become Ambassadors, and can do other activities specific to oblasts. Overseas citizens are Gishabruni citizens that are not Oblastian, which do not have these duties.
Article 3 - Obtaining Gishabruni Citizenship
To become a Gishabruni citizen, one send an application to the Director of Gishabruni Affairs. If said Director approves of the application, the person becomes a citizen of Gishabrun, unless this application is denied by the Board of Directors.
