Articles of Establishment (Pacem)

The Articles of Establishment is the current constitutional document of the State of Pacem.

Preamble

We, the people of the State of Pacem, in an effort to continue on the legacy of the Pacemian Reign, hereby establish these articles of establishment in order to properly begin the activity of the nation.

Article I - General provisions

Chapter I

  • 1. The name of the nation shall be the State of Pacem.
  • 2. It may be referred to as ‘Pacem’ in official documentation.
    • 2a. The use of “the state” is also permitted in official documentation.
  • 3. This chapter is given Founder’s Protection.

Chapter II

  • 1. The nation is a unitary parliamentary constitutional monarchy.
  • 2. The state shall be a unified nation of which the regions of the state are given limited autonomy.
  • 3. The capital of the state shall be the City of Nekut.

Chapter III

  • 1. The motto of the state shall be “tá ainm mór do na haoiseanna”.
    • 1a. The official translation of the motto into English shall be “a great name for the ages”.
  • 2. The official language of the state shall be Standard American English.

Chapter IV

  • 1. Nicholas Kaos is to be considered the sole founder of Pacem and be given full Founder’s Rights.
    • 1a. Founder’s Right is the right for the founder of the state to be able to change the nation however they see fit through decree.
  • 2. Decrees made by the Founder are considered to be above any rule of law.
  • 3. A Founder may ensure that a section of the articles or any future law document in Pacem may not be amended under any circumstances.
    • 3a. Under a section it shall read “this section has been given Founder’s Protection” if such is true.
    • 3b. A Founder is to keep a record of all parts of law they have given their protection.

Chapter V

  • 1. The Articles of Establishment may be referred to as “the Articles” in law.

Chapter VI

  • 1. In law, references to the Articles may be made as such.
    • 1a. “Article _, Chapter _, Section _, Subsection _”.
      • 1ai. This subsection is Article I, Chapter VI, Subsection 1.a.i under this rule.
    • 1b. “(Article number).(Chapter number).(Section number).(Subsection letter)”.
      • 1bi. This subsection is I.VI.1.a.i under this rule.

Article II - The Monarchy

Chapter I

  • 1. The executive branch of the state shall be headed as by the monarch.
  • 2. The monarch may be titled as Emperor or Empress.
  • 3. The monarch is the highest office and highest noble in all of Pacem.

Chapter II

  • 1. The powers of the monarch include the following:
    • 1a. Make imperial decrees;
      • 1ai. For the purpose of law, all imperial decrees are above the rule of the Articles.
    • 1b. represent Pacem internationally as a diplomat;
    • 1c. bestow titles and honors upon any individual;
      • 1ci. The titles of Earl and Viscount may only be given through subdivisions of the state and given to a citizen of that subdivision.
      • 1cii. The titles of Baron and Count may be given freely to any citizen.
      • 1ciii. The monarch may create special titles outside of these limitations.
      • 1civ. This subsection is given Founder’s Protection.
    • 1d. modify succession;
      • 1di. This subsection is given Founder’s Protection.
    • 1e. create ministries to assist them in their duties;
    • 1f. give assent to bills passed in the Senate;
    • 1g. accept the results of elections and referendums;
      • 1gi. If a bill is not given accent, or the results of an election or referendum are not accepted, they are considered null.
    • 1h. act as a judge for the state;
      • 1hi. When using this power the monarch is expected to be unbiased and expected to hear from both plaintiff and defendant, as well as utilize a jury to aid in the decision-making process.
    • 1i. govern and administrate the armed forces; and
    • 1j. declare war.
  • 2. The monarch shall also be the President of the Senate, and as such shall have the following powers:
    • 2a. Break any ties that arise in the Senate; and
    • 2b. end any filibuster at the monarch’s own will.

Chapter III

  • 1. The monarch shall hold the title “Emperor/Empress of Pacem”.
  • 2. The monarch shall hold the title “His/Her/Their Imperial Majesty”.
  • 3. The monarch shall hold the title “Emperor/Empress of the Reign”.

Article III - The Senate

Chapter I

  • 1. The Senate of Pacem is the head legislative body of the state.

Chapter II

  • 1. The Senate shall have the following powers:
    • 1a. Pass acts to be put into law; and
    • 1b. provide advice to the monarch.

Chapter III

  • 1. There shall be one elected seat in the Senate per every 2 citizens in a city or free territory.
    • 1a. In the event a city has one citizen, they shall be paired with the vote of the free territories.
  • 2. There shall be one elected seat for the free territories collectively.
  • 3. There shall be one elected seat for the colonies collectively.
  • 4. The monarch shall declare how many seats are up for election before an election begins regarding the rules of this chapter.
  • 5. There shall be an election for the Senate every four months.
    • 5a. To vote in an election, a citizen must have reached 13 years of age.
  • 6. Elections for the Senate shall utilize the single transferable voting system.

Chapter IV

  • 1. A member of the Senate shall be known as a Senator.
  • 2. A Senator must follow the following requirements:
    • 2a. Be at least 13 years of age;
    • 2b. Be a Pacemian citizen.

Article IV - The Military

Chapter I

  • 1. The military shall be referred to as the Armed Forces of the State.
    • 1a. The name ‘Armed Forces of Pacem’ or simply ‘Armed Forces’ may be used in official documentation.
  • 2. The Armed Forces shall serve the purposes of:
    • 2a. Protecting the state from foreign entities;
    • 2b. expanding the territory of the state;
    • 2c. protecting allies of the state; and
    • 2d. performing ceremonial duties as seen fit by the monarch.
  • 3. The Armed Forces are not permitted to use force against the citizens of the state. The Armed Forces are also not to be used as a police force for the state.
    • 3a. This subsection is given Founder’s Protection.

Chapter II

  • 1. The Armed Forces shall be divided into three branches:
    • 1a. The Army of the State;
    • 1b. the Navy of the State; and
    • 1c. the Airforce of the State.

Article V - The Economy

Chapter I

  • 1. The currency of the state shall be the Pacemian Imperil.
    • 1a. The United States dollar may also be accepted in official transactions.

Chapter II

  • 1. The monarch is given administrative control over the economy.
  • 2. The monarch has the following powers as the administrator of the economy:
    • 2a. Establish national banks and appoint Directors to administer them;
    • 2b. act as the director of the Central Bank of the State;
    • 2c. control the minting and distribution of the Imperil;
    • 2d. manage internal transactions;
    • 2e. allow the establishment of businesses; and
    • 2f. control interest rates.

Article VI - Subdivisions of the state

Chapter I

  • 1. The state is unitary, and all subdivisions of the state shall be given limited autonomy.
  • 2. Subdivisions of the state shall be divided as such, in order of precedence:
    • 2a. City
      • 2ai. Run by a Mayor.
      • 2aii. Cities may pass charters in conjunction with the Articles.
      • 2aiii. The title given through a city is a Earl/Lady.
    • 2b. Free Territory
      • 2bi. Run by a Governor.
      • 2bii. The title given through a free territory is a Viscount/Viscountess.
    • 2c. Colonies
      • 2ci. Run by a Commissioner.
      • 2cii. No titles may be given through a colony.
  • 3. The monarch has the power to change the status of a subdivision at any time.

Chapter II

  • 1. Subdivisions may make local laws that do not supersede state law.
  • 2. Cities and free territories may establish local legislative bodies in order to pass laws.

Article VII - Crimes against the state

Chapter I

  • 1. Treason is defined as working against the safety of the state in one’s own self-interest or working against the state in a manner that harms the general population.
  • 2. War crimes are crimes committed by the Armed Forces of the State before, during, or after combat.
    • 2a. War crimes include the following:
      • 2ai. The usage of tear gas against unarmed civilians;
      • 2aii. use of lethal weapons against unarmed civilians; and
      • 2aiii. use of lethal tactics against unarmed civilians.
    • 2b. This section is given Founder’s Protection.

Article VIII - Amending the articles

Chapter III

  • 1. The articles may be amended through a referendum supported by ¼ of all citizens of voting age. This referendum may be brought to the monarch, who may approve amendment to the articles.
  • 2. The monarch may amend the Articles at will.
