CONSTITUTION of the Confederation of Esse.

UNDERSTANDING the need for a concrete structure to the governance of our Confederation,

DEMANDING that the Essian people have a confederation that can provide strong governance that best supports their needs as a population,

HOPING to create a model that is stable and long-lasting,

WE SO DECLARE the following:

ARTICLE I

  1. The Confederation of Esse will have, at the forefront of its governing structure, a monarch; this monarch shall be the head of state of the Confederation, and shall form one-half of the Uber-Essian Diarchy;
  2. This monarch shall be known as the Lord/Lady, and his/her title shall be his/her Illustrious Majesty, the Lord/Lady of the Essians;
  3. The monarch of the Confederation shall hold said title for life, or until such a time as he/she chooses to abdicate in favor of a successor.
  4. The line of succession to the Essian throne is not, by design, hereditary; the monarch may decree a line of succession of whatever fashion he or she wishes;
  5. The Lord/Lady may issue decrees that may unilaterally amend this document, or that may alter the way of the Confederation’s governance.

ARTICLE II

  1. The Confederation shall be led largely by an elective cabinet, to be known as the Signoria; the Signoria shall act as both a cabinet and as a legislative body, which shall pass confederal bills into law;
  2. Members of the Signoria shall be elected in two fashions; Podesti shall be granted seats in the Signoria upon their election to the mayorship of cities; the remaining seats shall be elected through a preferential vote system, with the number of seats available to be determined by the outgoing Signoria, or by the Lord/Lady, at the latter’s discretion;
  3. Members of the Signoria must be registered citizens of the Confederation of Esse;
  4. The Confederation of Esse shall have a head of government, who shall be known as the Gonfaloniere; the Gonfaloniere shall act as the Confederation’s governor; the Gonfaloniere shall be elected to a term of two months by the members of the Signoria, and may serve no more than four consecutive terms;
  5. The Gonfaloniere shall have the final authority in signing confederal legislation into law;
  6. The Gonfaloniere shall have the authority to veto legislation; said veto may be overridden by a 2/3rd majority of Signoria members.
  7. The Gonfaloniere shall serve as the democratic face of the Confederation to the rest of the Union, and to the world;
  8. In the case of poor behavior, the Gonfaloniere may be removed by a 2/3rd vote of his/her peers, or unilaterally by the Lord/Lady.

ARTICLE III

  1. The Confederation shall have a second legislative body, to be known as the Parlamenzalochas, and to serve with no term limits and solely through appointment from the Lord/Lady;
  2. The Parlamenzalochas shall operate under the principle of assumed consent; following passage of a bill through the Signoria, the Parlamenzalochas shall have 48 hours to have at least 1/3rd of its members call for a vote; if the vote fails, the bill fails to pass.

ARTICLE IV

  1. Land within the Confederation of Esse shall be divided into subdivisions, which will be the following: city, town, and territory.
  2. Cities shall each be given, at the minimal, an elective mayor who shall represent the city in the Signoria and may unilaterally issue city-specific legislation; said mayor has the discretion to organize a larger and more formal city government, as well;
  3. Podesti shall be elected once every 4 months, unless otherwise altered by a city charter;
  4. The term “Podesta” shall be issued to individuals who hold the de facto position of Mayor of a given city;
  5. Towns shall be governed by either the Lordship or through the Parlamenzalochas and its members, at the discretion of the former;
  6. Territories shall be governed by the Gonfaloniere and his/her Signoria;

ARTICLE V

  1. Citizenship may be granted to any interested person through a unilateral decree from the Lordship;
  2. Citizens have the right to choose what city or territory they reside in, however the Lordship reserves the right to override said migration if it is determined to be in poor interest for the Confederation.

ARTICLE VI

  1. The Lord/Lady may designate Essian peerages to both citizens and non-citizens of the Confederation through unilateral decree. The order of such titles, from highest to lowest, shall be:
  2. Count, or Countess, and Earl;
  3. Viscount, or Viscountess;
  4. Baron, or Baroness;
  5. Patrician, or Patricianess;
  6. Cavaliere, or Cavalieress;

ARTICLE VII

  1. This document and the government it forms subscribes to the Rema Treaty of Union and the supremacy of its greater Union Government; this government subscribes to the basic rights of individuals described throughout the aforementioned document;
  2. This document may be amended in two fashions: unilateral decree or a majority vote in both the Signoria and the Parlamenzalochas;
  3. This document shall take effect immediately once it has been signed by both the Lord/Lady of the Essians, as recognized by the Rema Treaty of Union, and the Gonfaloniere, or Governor, as decreed by said Lord/Lady.
