Be it Enacted by his Royal Majesty Emperor Austin I, on the Second day of October 2019, under the term of Prime Minister Ethan Obsidian

An Act to - Set up fair punishments within offenders in the Empire of Iustus in respect of fair criminal law.

§0A Terminology

Macronational is any country which is

§0B Preliminary

  1. This Act may be cited for all purposes as the Criminal Code, 2019, R1 (S.I 2019)
  2. This Act may be cited if the Criminal Code, First Volume, 2018 is already cited as the Criminal Code, Second Volume, 2019, R1 (S.I 2019)
  3. The official and formal name of this act is An Act respecting criminal law, Revision one, October 2019, Parliament of the Empire of Iustus, on term of Prime Minister Jordan Micheals, written by Chief Justice Jayden Lycon, Esquire, Statute of Iustus 2019.
  4. This Act shall be effective on 20 October 2019

§1 Too Powerful to Content for Punishment

  1. These crimes shall be handed over to macro national law authorities
  2. These acts include
    1. Any offence which is also illegal in any residing macronational country
    2. Any offence outside Iustus or micronational borders
    3. Any offence with death or major injury
  3. Thus, if shall proven guilty, punishment shall be subjected to
    1. Handover to macro national law authorities
    2. Handover to macro government where the crime took place
      1. Any crime reported in Western Sahara, Disputed Territory of, shall be handed over to the United Nations for investigation purposes.
    3. Impeachment of office
    4. Immediate deportation and ban from the Empire of Iustus
  4. To Power to Content for Punishment shall be classified as a “first class felony”

§2 Minor Offences

  1. These acts include
    1. Any offence which is seemed as a “minor offense” in valid Iustus law.
  2. Thus, if shall proven guilty, punishment shall be subjected to one or more of:
    1. Fine of 50 IUD
    2. Fine of 100 IUD
    3. Fine of 200 IUD
    4. Public Apology
    5. Ban from Iustus Discord Server for 1 week
  3. Minor Offences shall be classified as a “mistemounes”

§3 Treason

  1. These acts include
    1. An attempt, or to overthrow the current government regining the Empire of Iustus and its territories, provinces, and any other land masses
    2. Acts to betray the government regining the Empire of Iustus and its territories, provinces, and any other land masses
    3. Unlawful illegal succession from the Empire of Iustus
    4. Making a state independent without a valid justification or valid agreement from the Empire of Iustus or written consent from the Iustus Government
  2. Thus, if shall proven guilty, punishment shall be subjected to one of more of:
    1. Imprisonment of a minimum of 1 month to a maximum of 6 months
    2. Immediate deportation and ban from the Empire of Iustus
    3. Fine of 500,000 IUD
    4. Fine of 1,000,000 IUD
    5. Combined total of up to 48 hours of community service
    6. Ban from Iustus Discord Server for 1 month
    7. Ban from Iustus Discord Server for 2 months
    8. Permanent ban from the Iustus Discord Server
    9. Impeachment of office
    10. Public Apology
  3. Treason shall be classified as “first class felonies”

§4 Unlawful Assemblies

  1. These acts include
    1. To participate or to hold an assembly which has been deemed “unlawful” by the Empire of Iustus
    2. To participate or to hold an assembly which disturbs peace in an area (also known as a “riot”)
    3. To use violent forces in an assembly
  2. Thus, if shall proven guilty, punishment shall be subjected to one of more of:
    1. Imprisonment of a minimum of 1 day to a maximum of 1 month
    2. Payment of all damages done
    3. Fine of 350,000 IUD
    4. Fine of 500,000 IUD
    5. Fine of 850,000 IUD
    6. 1 month ban from the Iustus Discord Server
    7. 2 month ban from the Iustus Discord server
    8. Immediate deportation and ban from the Empire of Iustus
    9. Combined total of up to 24 hours of community service
    10. Public Apology
  3. Unlawful Assemblies shall be classified as “first class felonies”

§5 Fraud

  1. These acts include
    1. Unlawful deception for a political, monetary, or personal gain
    2. Misrepresentation for political, monetary, or personal gain
  2. Thus, if shall proven guilty, punishment shall be subjected to one or more of:
    1. Fine of 100,000 IUD
    2. Fine of 200,000 IUD
    3. Fine of 500,000 IUD
    4. Fine of 50,000 IUD
    5. 1 month ban from the Iustus Discord Server
    6. 2 month ban from the Iustus Discord Server
    7. Immediate deportation and ban from the Empire of Iustus
    8. Payment of all damages done
    9. Public Apology
    10. Ban from Iustus Discord Server for 1 week
    11. Impeachment of office
    12. Imprisonment of a minimum of 1 month to a maximum of 6 months
  3. Fraud shall be classified as “first class felonies”

§6 Bribery

  1. These acts include
    1. Using any reward for political gain
    2. Using any reward for monetary gain
    3. Using any reward for personal gain
  2. Thus, if shall proven guilty, punishment shall be subjected to one or more of:
    1. Fine of 10,000 IUD
    2. Fine of 20,000 IUD
    3. Impeachment of office
    4. 1 month ban from the Iustus Discord Server
    5. Payment of all damages done
    6. Public Apology
    7. Imprisonment of a minimum of 1 month to a maximum of 3 months
  3. Bribery shall be classified as “second class felonies”

§7 Forgery

  1. These acts include
    1. Writing on behalf of someone else, however the plaintiff did not authorize you to do said action.
    2. To copy a document, signature, IUD, government documents, etc without authorization from the owner of said document.
      1. UNLESS the document was the Canadian Dollar or any other macro currency, it shall be trialed under the Criminal Code, §1, Too Powerful to Content for Punishment
  2. Thus, if shall proven guilty, punishment shall be subjected to one of more of:
    1. Fine of 50,000 IUD
    2. Fine of 25,00 IUD
    3. Fine of 100,000 IUD
    4. Payment of all damages done
    5. Combined total of up to 12 hours of community service
    6. Public Apology
    7. Removal of document forged
  3. Forgery shall be classified as a “second class felony”

§8 Theft

  1. These acts include
    1. Unauthorized stealing of a property which you do not own
  2. Thus, if shall proven guilty, punishment shall be subjected to one of more of:
    1. Imprisonment
    2. Fine of 5,000 IUD
    3. Fine of 10,000 IUD
    4. Fine of v x 10 IUD, “v” indicating the manufacturer's suggested retail price. (“MSRP”)
    5. Payment of all damages done
    6. Return of affected property
    7. Combined total of up to 24 hours of community service
    8. Public Apology
  3. Theft shall be classified as:
    1. If the theft was valued below $30 CAD, or $250 IUD, it shall be a “misdemour”
    2. If the theft was valued above $30 CAD, or $250 IUD, but below $99.99 CAD or $1499.99 IUD, it shall be a “second class felony”
    3. If the theft was valued above $100 CAD, or $1500 IUD, it shall be a “first class felony”
    4. If the theft contained any government property deemed “classified” before the offence was incurred, it shall be a “first class felony”

§9 Offences Against Public Order

  1. These acts include
    1. Rioting
    2. Violence
    3. Public nuisance
  2. Thus, if shall proven guilty, punishment shall be subjected to one of more of:
    1. Imprisonment
    2. Fine of 10,000 IUD
    3. Fine of 50,000 IUD
    4. Fine of 100,000 IUD
    5. Payment of all damages done
    6. Public Apology
    7. Combined total of up to 48 hours of community service
  3. Offences Against Public Order shall be classified as:
    1. If it violated Criminal Code, 2019, R1 (S.I 2019) §9 “Offences Against Public Order” 1.c, it shall be a “misdemour”
    2. If it violated Criminal Code, 2019, R1 (S.I 2019) §9 “Offences Against Public Order” 1.a, 1.b, it shall be a “first class felony”

§9 (§10) Elections Tampering

  1. These acts include
    1. Unauthorized tampering of Iustus-sanctioned elections
  2. Thus, if shall proven guilty, punishment shall be subjected to one of more of:
    1. Imprisonment
    2. 1 month ban from the Iustus Discord Server
    3. Impeachment from office
    4. Fine of 10,000 IUD
    5. Fine of 50,000 IUD
    6. Fine of 100,000 IUD
    7. Public Apology
    8. Combined total of up to 48 hours of community services
  3. Elections Tampering shall be classified as a “first class felony”

§10 (§11) Identity Fraud

  1. These acts include
    1. To use someone’s identity without prior authorization or permission
  2. Thus, if shall proven guilty, punishment shall be subjected to one or more of:
    1. Imprisonment
    2. 1 month ban from the Iustus Discord Server
    3. Fine of 10,000 IUD
    4. Fine of 50,000 IUD
    5. Fine of 100,000 IUD
    6. Public Apology
    7. Surrender of documents used in violation
    8. Combined total of up to 48 hours of community services
  3. Identity Fraud shall be classified as a “second class felony”

§11 (§12) Defamation

  1. These acts include
    1. False statements / false actions to damage someone else’s reputation
  2. Thus, if shall proven guilty, punishment shall be subjected to one or more of
    1. Imprisonment
    2. 1 month ban from the Iustus Discord Server
    3. Impeachment of office
    4. Fine of 10,000 IUD
    5. Fine of 50,000 IUD
    6. Fine of 100,000 IUD
    7. Public Apology
    8. Recall of documents used in violation
    9. Combined total of up to 48 hours of community services
  3. Defamation shall be classified as a:
    1. If it involves citizens or government workers, a “second class felony”
    2. If it involves the HRM Rt. Hon. Emperor of the Empire of Iustus, a “first class felony”

§12 (§13) Gambling to an Extent of Iustus Monetary Notes

  1. These acts include
    1. Waging of class in an uncertain event if under the legal age of the macronation using IUD.
  2. Thus, if shall proven guilty, punishment shall be:
    1. Fine of 100 IUD
    2. Fine of 500 IUD
    3. Fine of v x 10 IUD, “v” represents the amount gambled
    4. Surrender of amount won
  3. Gambling to an Extent of Iustus Monetary Notes shall be classified as a “misdemeanor”

§13 (§14) Gambling to Macrocurrency

  1. These acts include
    1. Waging of class in an uncertain event if under the legal age of the macronation using macrocurrency, where gambling under the legal age is illegal, if there is a legal age. If there is no legal age, this section does not apply.
  2. Thus, if shall proven guilty, punishment shall be one or more of:
    1. Extradition to the country where it took place
    2. Extradition to the country where the violator’s citizenship is located
    3. Deportation from Iustus
  3. Gambling to Macrocurrency shall be classified as a “first class felony”

§13 (§15) Harassment

  1. These acts include
    1. Threats, pressure, intimidation to do something on the lines of sexual, montary, political, or justice achievements.
  2. Thus, if shall proven guilty, punishment shall be one or more of:
    1. Imprisonment
    2. 1 month ban from the Iustus Discord Server
    3. Deportation from the Iustus
    4. Extradition to the country where it took place
    5. Extradition to the country where the violator’s citizenship is located
    6. Impeachment from office
    7. Fine of 10,000 IUD
    8. Fine of 50,000 IUD
    9. Fine of 100,000 IUD
    10. Public Apology
    11. Combined total of up to 48 hours of community services
    12. Harassment shall be classified as a “first class felony”

§14 (§16) Discrimination

  1. These acts include:
    1. Unjust and / or unfair treatment due to their
    2. Race
    3. Ethnicity
    4. Background
    5. Economic status
    6. Place
    7. Origin
  2. Thus, if shall proven guilty, punishment shall be one or more of:
    1. Imprisonment
    2. 1 month ban from the Iustus Discord Server
    3. Impeachment of office
    4. Fine of 10,000 IUD
    5. Fine of 50,000 IUD
    6. Fine of 100,000 IUD
    7. Public Apology
    8. Recall of documents used in violation
    9. Combined total of up to 48 hours of community services
  3. Discrimination shall be classified as a “second class felony”
  4. If speech was also used, refer to Criminal Code, 2019, R1 (S.I 2019) §20 “Hate Speech”

§15 (§17) Judicial Interference

  1. These acts include
    1. Interference in the Judicial process
  2. Thus, if shall proven guilty, punishment shall be one or more of:
    1. Imprisonment
    2. 1 month ban from the Iustus Discord Server
    3. Impeachment of office
    4. Fine of 100,000 IUD
    5. Fine of 500,000 IUD
    6. Fine of 1,000,000 IUD
    7. Public Apology
    8. Recall of documents used in violation
    9. Combined total of up to 48 hours of community services
  3. Judicial Interference shall be classified as a “first class felony”

§16 (§18) Constitutional Violations, which do not include section “XX Human Rights”

  1. These acts include
    1. Violations to the Constitution of Iustus, not including violations which fall under “XX Human Rights”
  2. Thus, if shall proven guilty, punishment shall be one or more of:
    1. Fine of 10,000 IUD
    2. Fine of 50,000 IUD
    3. Fine of 100,000 IUD
    4. Public Apology
    5. Combined total of up to 72 hours of community services
  3. Constitutional Violations, which do not include section “XX Human Rights” shall be classified as a “second class felony”

§17 (§19) Constitutional Violations, which only include section “XX Human Rights”

  1. These acts include
    1. Violations to the Constitution of Iustus, section “XX Human Rights”
  2. Thus, if shall proven guilty, punishment shall be one or more of:
    1. Imprisonment
    2. Deportation from the Iustus Discord Server
    3. Impeachment of office
    4. Fine of 30,000 IUD
    5. Fine of 80,000 IUD
    6. Fine of 200,000 IUD
    7. Public Apology
    8. Recall of documents used in violation
    9. Recall of statement used in violation
    10. Combined total of up to 200 hours of community services
  3. Constitutional Violations, which only include section “XX Human Rights” shall be classified as a “first class felony”

§18 (§20) Negligence

  1. These acts include
    1. Failure to take proper care in doing something in jobs which are considered “high risk”, without resulting in injuries or death
  2. Thus, if shall proven guilty, punishment shall be one or more of:
    1. 1 month ban from the Iustus Discord Server
    2. Fine of 5,000 IUD
    3. Fine of 10,000 IUD
    4. Fine of 50,000 IUD
    5. Public Apology
    6. Payment of all property damaged
    7. Combined total of up to 48 hours of community services
    8. Negligence shall be classified as a “misdemour”
  3. If there is a result of death or injuries, refer to Criminal Code, 2019, R1 (S.I 2019) §1 “Too Powerful to Content for Punishment”

§19 (§21) Vandalism

  1. These acts include
    1. Intentionally removing or adding of something which can harm someone
    2. Anying which the property owners did not authorize to put up
  2. Thus, if shall proven guilty, punishment shall be one or more of:
    1. 1 month ban from the Iustus Discord Server
    2. Fine of 5,000 IUD
    3. Fine of 10,000 IUD
    4. Fine of 50,000 IUD
    5. Public Apology
    6. Payment of all property damaged
    7. Combined total of up to 48 hours of community services
  3. Vandalism shall be classified as a “misdemour”
  4. If there is a result of death or injuries, refer to Criminal Code, 2019, R1 (S.I 2019) §1 “Too Powerful to Content for Punishment”

§20 (§22) Hate Speech

  1. These acts include
    1. Speech to offend people on the grounds of
      1. Race
      2. Ethnicity
      3. Background
      4. Economic status
      5. Place
      6. Origin
  2. Thus, if shall proven guilty, punishment shall be one or more of:
    1. Imprisonment
    2. 1 month ban from the Iustus Discord Server
    3. Impeachment of office
    4. Fine of 10,000 IUD
    5. Fine of 50,000 IUD
    6. Fine of 100,000 IUD
    7. Public Apology
    8. Recall of documents used in violation
    9. Combined total of up to 48 hours of community services
  3. Hate Speech shall be classified as a “second class felony”
  4. If unfair or unjust treatment was used, refer to Criminal Code, 2019, R1 (S.I 2019) §14 “Discrimination”

§21 (§23) Sedition

  1. These acts include
    1. Speech to make people rebel against the Iustus Government or HRM Rt. Hon. Emperor of Iustus
  2. Thus, if shall proven guilty, punishment shall be one or more of:
    1. Imprisonment
    2. 1 month ban from the Iustus Discord Server
    3. Impeachment of office
    4. Fine of 10,000 IUD
    5. Fine of 50,000 IUD
    6. Fine of 100,000 IUD
    7. Public Apology
    8. Recall of documents used in violation
    9. Combined total of up to 48 hours of community services
  3. Sedition shall be classified as a “first class felony"

§22 (§24) Failure to Appear to Court

  1. These acts include
    1. The action of failing to appear in the Courts of the Empire of Iustus without a prior lawful excuse which you are mandated from the government to appear in.
  2. Thus, if shall proven guilty, punishment shall be one or more of:
    1. Imprisonment
    2. Fine of 1,000 IUD
    3. Fine of 5,000 IUD
    4. Fine of 25,000 IUD
    5. Public Apology
  3. Failure to Appear to Court shall be classified as a “misdemeanor”

§23 (§25) Unlawful Sharing of Case Details

  1. These acts include
    1. The action of sharing details of a case which is currently being trialed or processing through the Courts of the Empire of Iustus to the public, whereas you signed an agreement agreeing that you will not share details of a case to the public.
  2. Thus, if shall proven guilty, punishment shall be one or more of:
    1. Imprisonment
    2. Fine of 5,000 IUD
    3. Fine of 20,000 IUD
    4. Fine of 50,000 IUD
    5. Public Apology
    6. Recall of documents used in violation
    7. Combined total of up to 24 hours of community services
    8. Unlawful Sharing of Case Details shall be classified as a “first class felony”

§24 (§26) Failing to Call Elections

  1. These acts include
    1. The action of deliberately failing to call an election when an electoral position’s term is due
  2. Thus, if shall proven guilty, punishment shall be one or more of:
    1. Imprisonment
    2. 1 month ban from the Iustus Discord Server
    3. Impeachment from office
    4. Fine of 10,000 IUD
    5. Fine of 50,000 IUD
    6. Fine of 100,000 IUD
    7. Public Apology
    8. Combined total of up to 48 hours of community services
  3. Failing to Call Elections shall be classified as a “first class felony”

JURISDICTION AND AMENDS

Criminal Code, Second Volume, 2019, R1 (S.I 2019) applies to laws governing the provinces of the Empire of Iustus. Laws which govern the administration of the Empire of Iustus Discord Service do not follow the Criminal Code, Second Volume, 2019, R1 (S.I 2019).

This act may be voided with a majority vote from the Government of the Empire of Iustus and representation from its people through a referendum.

Amendments to this document is allowed through a majority vote from the Government of the Empire of Iustus. Amendments require the approval from both the Chief Justice and Minister of Justice to make sure they are ethical.
